Chapter 7 Bankruptcy

Chapter 7 bankruptcy is an option for both businesses and individuals, and it involves asset liquidation to relieve debt. You must pass a "means test' in order to qualify for this type of bankruptcy. A debtor has a $35,000 exemption in the equity of his or her residence ($60,000 exemption if the debtor is a widow or widower and at least 65 years of age). If the husband and wife own their residence jointly under a tenancy by the entirety, creditors of most claims (non-medical bills and non-taxes) will have no claim against any of the equity in the residential property. Chapter 11 Bankruptcy

Chapter 11 bankruptcy is for businesses only. It can be used for companies, sole proprietorships, and partnerships, and it allows you to continue in business while reorganizing debts that are owed to creditors.

Chapter 13 Bankruptcy

Chapter 13 bankruptcy can allow you to keep your home and repay creditors in installments over a three to five-year period of time. The monthly payment would have to be large enough to continue to make your regular house payment and to pay in affordable installments any mortgage arrearages. Vehicle loans may be payable under a different schedule and possibly lower interest rate, and in some cases, a lower principle balance owed. Unsecured creditors typically receive a percentage, possibly as low as 0. You must have sufficient income for the plan to work and for you to afford your regular monthly expenses. Income taxes owed can be paid through Chapter 13. Under limited conditions, arrearages taxes may at least in part be dischargeable in bankruptcy. Contact Attorney Krueger for more details.
